On 27 July 2026, the President of the Republic of Azerbaijan signed Law No. 452-VIIQD dated 14 July 2026 (the Law), which amends several legislative acts, including the Civil Code of the Republic of Azerbaijan (the Civil Code). Among other changes, Article 2 of the Law introduces a new legal framework for corporate agreements. This blog post provides an overview of corporate agreements, outlines their prior treatment in Azerbaijan, and summarises the new rules introduced by the Law and highlights its key ambiguities.

Comparative Analysis of the Bona Fides Principle Between Azerbaijan and the United Kingdom
This paper examines the principle of bona fides in contract law through a comparative analysis of Azerbaijani and English legal systems. Azerbaijani legislation formally enshrines ““vicdanlılıq”” (good faith) as a civil law standard, yet courts lack a consistent method for its interpretation. English law rejects a general duty of good faith but achieves similar outcomes through specific doctrines — utmost disclosure in insurance, implied cooperation in relational contracts, and consumer protection statutes. Using doctrinal and comparative methods, the paper proposes reforms for Azerbaijan, including textual amendments to the Civil Code, model decisions from higher courts, and clearer remedies for breaches of good faith.

A Paper Shield? Comparative Analysis of Türkiye, Germany, and Azerbaijan’s Legislation in Protective Measures
This blog examines shortcomings in Azerbaijan’s Law on Prevention of Domestic Violence and their compatibility with Articles 3 and 8 of the ECHR. Key issues include the absence of perpetrator eviction measures, the 180-day limit on protection orders, the requirement of a prior violation before long-term protection can be granted, the “normalize relations” mandate, and the law’s restriction to cohabitants and domestic settings. The case of Ilknur Durak, a healthcare worker harassed by a colleague in Istanbul, illustrates these gaps by asking a question: whom does the law protect? [12] Unlike Turkish and German law, Azerbaijani law limits protection orders to relatives or cohabitants, leaving victims of non-domestic stalking and harassment unprotected. This blog recommends ratifying the Istanbul Convention, allowing perpetrator eviction, removing time limits, repealing the “normalize relations” mandate, and extending protection based on victim safety rather than the relationship between victim and perpetrator.

A legal system exists when people generally follow primary rules and officials accept secondary rules, especially the rule of recognition, which determines legal validity. The question of whether a foreign judgment can have domestic legal impact regularly arises before national courts and arbitral tribunals. This relationship emphasizes how important it is for legal systems to have mutual trust and consistent enforcement standards. Despite the existence of common principles and attempts aimed at harmonization, the process still depends heavily on national legal systems and their specific rules. This paper examines the legal structures that govern recognition, enforcement and grounds for refusal focusing especially on public policy.

Dudgeon v. the United Kingdom: Criminalisation of Homosexuality and the Right to Private Life
In Dudgeon v. United Kingdom, the European Court of Human Rights addressed whether the laws criminalising consensual homosexual acts between adults violate Article 8 of the ECHR. The Court found that the mere existence of such legislation constitutes a continuous interference with private life by creating fear and psychological pressure, even without prosecution.
